Alabama Woman Shot In The Stomach Charged With Manslaughter For Unborn Baby's Death

Charges against the shooter have been dismissed.

An Alabama woman suffered a miscarriage after being shot during a dispute. But it's the shooting victim and not the shooter who has been charged with the unborn baby's death.

Marshae Jones, a 27-year-old from Birmingham, was charged with manslaughter and subsequently indicted by a Jefferson County grand jury, according to AL.com. She was taken into custody on Wednesday. The person who shot her, Ebony Jemison, had initially been charged with manslaughter by police. But the charges against the 23-year-old Jemison were dismissed.

Authorities said that Jones is responsible for the death because she initiated a dispute that led to the shooting. The incident occurred back in December 2018, when police were dispatched to a Dollar General after receiving a report of someone being shot.

"The investigation showed that the only true victim in this was the unborn baby,’" Pleasant Grove police Lt. Danny Reid said at the time of the shooting. "It was the mother of the child who initiated and continued the fight which resulted in the death of her own unborn baby."

Police found Jones at a convenience store following the shooting and took her to the hospital. The 27-year-old was five months pregnant. The baby did not survive the shooting.

Reid said the fight stemmed over the unborn child's father, and was incited by Jones who pressed the fight against Jemison.

"Let's not lose sight that the unborn baby is the victim here," Reid said. "She had no choice in being brought unnecessarily into a fight where she was relying on her mother for protection."

Jones will be transferred to the Jefferson County Jail and will be held there on $50,000.

The story has gained a number of reactions on social media, with people outraged that Jones is being blamed for the death of her unborn child.
