Nipsey Hussle’s Accused Killer Wants Two Attempted Murder Charges Dropped

Eric Holder is set to appear in court on November 11.

Attorneys representing Eric Holder, the man accused of killing Nipsey Hussle, have requested “that two of his charges be dismissed.” According to The Grio, he appeared in a pretrial hearing in Los Angeles last week.

Prosecutors reportedly say Holder fatally shot Hussle following an argument with the rapper in front of his Marathon Clothing Store in Los Angeles back in March. Holder was “charged with one count of murder as well as two counts of attempted murder for shooting a man named Kerry Lathan and his nephew.” Additionally, he was also “charged with one count of possession of a firearm by a felon.” Holdr

AllHipHop reports that his legal team has asked that the two counts of attempted murder be dropped. The attempted charges allegedly fit within the “Kill Zone” theory. According to The Los Angeles Times: “Since 2002, the state has convicted defendants of the attempted murder of people who were not a defendant’s primary target but were near or at the crime scene — regardless of whether that person was injured.”

Deputy District Attorney, John McKinney stated that Holder’s case fits within the “Kill Zone” parameter and “suspects the attempt to have the two charges dropped is just a ploy to prolong the case,” reports The Grio. McKinney added that “the alleged shooter waived his right to have a trial within 60 days after his indictment.”

In an interview with USC Anberg Anneberg‘s student run website, McKinney also shared:

“Given the magnitude of the case, the complexities of the case, work his defense attorney needs to do, he knew it wasn’t in his best interest to try to go to trial right now.”

Holder is slated to appear in court on November 11. On this date prosecutors are reportedly “expected to object Holder’s motion to dismiss the attempted murder charges.”
