Holder reportedly fatally shot Hussle earlier this year outside of Marathon Clothing Store in South L.A.

On Thursday, Nipsey Hussle's alleged killer Eric Holder was unsuccessful in his attempt to throw out his attempted murder charges.

In a report by XXL, according to the Los Angeles County District Attorney’s Office, a judge denied his motion to "dismiss the attempted murder charges related to the two other victims that he allegedly hit when he allegedly fatally shot Nipsey Hussle in front of his Marathon Clothing Store on March 31."

Previous reports have stated that Holder allegedly fatally shot and killed Hussle following an argument with him outside his Marathon Clothing Store in South L.A. back in March. Holder's counsel believed this case fits into the "Kill Zone" theory, described by USC Anneberg Media below:

"In order for the "Kill Zone" theory to apply when determining attempted murder, six factors must be proven: there is a primary target, type of weapon used, distance between the shooter and target, proximity to other victims to target, whether victims are in an enclosed area, and whether the target was moving in the attack."

Los Angeles Superior Court Judge Robert J. Perry reportedly rejected the motion and determined there was enough to go to the jury, according to Complex. Holder reportedly opened fire on Nipsey after becoming angry after he was accused of being a "snitch." XXL reports Holder was arrested on April 2 and charged with "one count of murder, two counts of attempted murder and one count of possession of a firearm by a felon." Just a few weeks ago, Holder's legal team asked the court to dismiss the latter two charges.

Holder is being held at Twin Towers Correctional Facility in Los Angeles on $6.53 million bond. The case is slated to go to trial in February, according to XXL "if convicted, he faces life in prison."
