A 15-year-old was fatally shot by an off-duty U.S. Customs and Border Patrol agent in California.

On Friday night Darius Smith was fatally shot by the agent after he and two 14-year-old boys (one of which was Smith's cousin) allegedly tried to rob the officer at gunpoint after they all exited a train. The agent claims that he was forced to shoot the teens in self-defense. Smith was hospitalized and died Saturday morning from his injuries. Smith's cousin's injuries were not life-threatening. However, both the cousin and the third teenager still face robbery charges.

The border agent was allegedly bruised but did not require hospitalization.

Reshawna Myricks, Smith's mother, does not believe her son and the accompanying teenagers attempted to rob the agent, arguing that the narrative against them is not consistent.

"First they said there was no crime committed," Myricks said in an interview with KCAL9. "Now there is a crime committed. Now it's a gun; then they said there was a fight. I don't know what to believe. All I know is my baby [is] gone and I'll never know his story."

"Them boys didn't do that," Myricks added. "They aren't those type of boys to do that."

Lee Merritt, the attorney for Smith's family, also does not believe in the agent's account of the incident. Merritt says that along with reviewing the case he has spoken with the teenagers involved in the incident as well as their families, and has also spoken with an eyewitness.

"Despite multiple shots from the killer, not one shot was fired from the gun allegedly carried by these boys (the reports are a toy gun was found near the scene)," Merritt wrote in a Facebook post. "While he was emptying his clip they appeared to be running for their lives."
