A California judge dismissed a counterclaim against Lizzo, but offered the plaintiffs an opportunity to amend their suit and present new facts by September 4th.

The long-running legal saga centering on Lizzo's 2017 smash, "Truth Hurts," could soon be coming to an end.

According to documents obtained by Pitchfork, a California judge issued a dismissal of a countersuit brought against the singer in 2019. The claim was in response to the singer's own suit seeking a judicial declaration against songwriters, Yves Rothman and brothers, Justin and Jeremiah Raisen, who alleged on Instagram that the breakout song plagiarized elements (chords, melody, and lyrics,) of their song "Healthy," including the line "100% that bitch," which the singer moved to trademark in 2019. In a New York Times interview, Lizzo's attorney, Cynthia S. Arato, stated, "They did not collaborate with Lizzo or anyone else to create this song, and they did not help write any of the material that they now seek to profit from."

While the judge granted the singer's request for a dismissal of the counterclaim brought against her, Lizzo's not in the clear just yet. U.S. District Court Judge Dolly M. Gee offered Rothman and The Raisens an opportunity to amend their suit and present new facts in support of their allegations. They were given until September 4th to tweak their argument and file a new suit or inform the court of their intention to not pursue further litigation.

In a statement, Justin Raisen's attorney, Larry Iser, indicated the plaintiffs aren't backing down. Iser wrote, "We will be submitting amended counterclaims, which will address the court’s concerns with our original pleading. We know the truth may hurt, but Lizzo will not be able to continue denying our clients’ substantial contributions to the Grammy winning song for much longer."
