DJ Khaled Reportedly Plans Lawsuit Against Billboard Chart After Losing No. 1 Spot

Billboard allegedly discounted Father of Asahd downloads as part of an energy drink “bundle deal.”

DJ Khaled is reportedly planning to launch a lawsuit against the Billboard Chart.

According to a report in Page Six, the DJ and producer is alleging the organization unfairly disqualified more than 100,000 sales of his latest album, Father of Asahd, resulting in him losing the No. 1 spot.

Khaled’s project landed the No.  2 spot, after Tyler, the Creator’s “IGOR.” Billboard allegedly discounted downloads Khaled sold as part of an energy drink “bundle deal.”

Page Six reports Billboard agreed it would count downloads from Khaled’s energy drink bundle deal, but they later backtracked, arguing that there were “anomalies” in his figures. Khaled’s lawyers reportedly sent a letter to Silvio Pietroluongo, SVP of charts and data development at Billboard.

A source close to Khaled told Billboard, the ordeal was unjust because Tyler, the Creator’s bundle deal figures were included in his total sales. But a Billboard source reportedly disputed that 100,000 DJ Khaled sales were disqualified, and admitted that an undisclosed number of his sales were ruled out because “there were strange anomalies in the data.” They charge the decision was based on chart rules following talks with Khaled’s management, Sony Records and Nielsen.

Bundle deals are standard but controversial, as they offer album downloads alongside merchandise to boost sales. Last year, Nicki Minaj criticized Travis Scott for using a merch bundle deal for his No. 1 album, Astroworld.

Billboard announced it has reviewed its rules regarding artists’ bundle albums with merch and is gearing up to outline a new policy for 2020.
